On May 1,2009, the FAA issued a "Notice of Retroactive Payment for FLSA Overtime." NATCA bargaining unit members began receiving this Notice late last week. The FAA issued this Notice directly to employees without providing prior notice to NATCA or the law firm Woodley& McGillivary - that is representing ATCA members in the NATCA sponsored FLSA lawsuit entitled Abbey v. Us. which is currently pending in the U.S. Court of Federal Claims.

WASHINGTON, D.C. - Mediation aimed at ending an ongoing contract dispute between the Federal Aviation Administration (FAA) and the National Air Traffic Controllers Association (NATCA) began yesterday. Both parties signed a process agreement to move the negotiations forward as planned. The agreement provides for extensive mediation sessions and for binding resolution of any unresolved issues, guaranteeing a new collective bargaining agreement between the parties.

On April 3, 2009, the Office of Personnel Management (OPM), announced a new Federal law that entitles certain federal employees, absent from federal employment due to active military duty, to receive supplemental pay when their military pay and allowances are less than their civilian basic pay (basic pay includes base and locality). The law specifically states that FAA shall, in consultation with OPM, develop procedures to ensure that the rights under this new section apply to FAA employees. It is effective on March I5, 2009.
Once this process has been finalized, employees will be paid the applicable amount retroactive to March 15,2009.
